Terms of Service

Agreement to Terms

By accessing or using Elysian’s platform, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the service. Elysian is made available to schools and institutions under a separate institutional agreement; these Terms govern individual use of the platform by teachers, school administrators, and students once access has been granted.

Eligibility

Elysian is currently intended for use by students aged 13 and older, and by teachers and school administrators acting on behalf of a participating institution. Access to the platform is by invitation only: school administrators create classes and invite teachers and students. By inviting or accepting an invitation to use Elysian, the school confirms that all invited students meet this minimum age requirement.

Use of Service

Elysian provides a gamified social-emotional wellbeing platform for educational institutions. You agree to:

• Use the platform only for its intended educational and wellbeing purpose
• Provide accurate information during registration
• Maintain the security of your account credentials
• Not misuse or attempt to disrupt the service
• Respect other users and maintain appropriate conduct

Educational Institution Responsibilities

Educational institutions using Elysian agree to confirm that participating students meet our minimum age requirement, comply with applicable education and privacy laws (including FERPA), designate appropriate staff to review safeguarding flags raised by the platform, and use student data only for educational and wellbeing purposes in accordance with our Privacy Policy.

AI Features

Elysian uses artificial intelligence to help generate wellbeing workout content for teacher review, and to automatically scan student responses for indicators of risk such as self-harm, abuse, or bullying, surfacing them to school staff for human review. AI-generated content and flags may contain errors, omissions, or false positives/negatives, and are provided as a supporting tool only — they do not replace the professional judgment of teachers, counselors, or other school staff.

Not a Substitute for Professional Care

Elysian is an educational wellbeing tool and is not a medical device, therapy service, or substitute for professional mental health diagnosis, treatment, or crisis intervention. If a student is in crisis or at risk of harm, schools and staff should follow their existing safeguarding procedures and contact appropriate emergency or mental health services immediately, rather than relying on Elysian alone.

Intellectual Property

The Elysian platform, including all content, features, and functionality, is owned by Elysian and protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission. Schools and students retain ownership of the personal content they submit (such as mood notes and workout responses), which we use solely as described in our Privacy Policy.

Limitation of Liability

Elysian provides educational and wellbeing tools and is not a substitute for professional mental health services. In no event shall Elysian be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including damages arising from reliance on AI-generated content or safeguarding flags.

Modifications to Service

We reserve the right to modify or discontinue the service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the service.

Termination

We may terminate or suspend your access to the service immediately, without prior notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties.
